Last updated: February 5, 2025

1. Experimental Software

Oak is currently experimental software provided by Oakspace Inc. The service, including the CLI tool, server, and all related components, is under active development and may contain bugs, undergo breaking changes, or experience downtime without notice.

By using Oak, you acknowledge that:

  • Features may change, break, or be removed at any time
  • Data loss is possible — always maintain independent backups of your code
  • The service may be interrupted, suspended, or discontinued without advance notice
  • The software is not yet recommended for production-critical workflows

2. Acceptance of Terms

By accessing or using Oak (including installing the CLI, pushing code to an Oak server, or using the hosted service at oak.space), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

3. Your Code and Content

You retain all ownership rights to the code and content you store using Oak. We do not claim any intellectual property rights over your content.

By using the service, you grant Oakspace Inc. a limited license to store, process, and transmit your content solely for the purpose of operating and providing the service (e.g., storing blobs, syncing commits between clients).

4. Acceptable Use

You agree not to use Oak to:

  • Store or distribute malware, viruses, or malicious code
  • Host content that violates applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to the service or other users' data
  • Interfere with or disrupt the service's infrastructure
  • Use the service for any illegal purpose

We reserve the right to suspend or terminate access for any user who violates these terms.

5. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Oakspace Inc. does not warrant that the service will be uninterrupted, error-free, or secure, or that any defects will be corrected. You use the service at your own risk.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OAKSPACE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OAKSPACE INC.'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

7. Service Modifications and Termination

We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time, with or without notice. We may also modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

You may stop using the service at any time. We recommend exporting or backing up your data before discontinuing use, as we may delete inactive data after a reasonable period.

8. CLI Software

The Oak CLI is distributed as a compiled binary. By installing and running it, you acknowledge that:

  • The CLI accesses your local filesystem to read and write files in Oak-initialized directories
  • The CLI communicates with Oak servers to sync your data when you use push/pull commands
  • You are responsible for reviewing what you install and run on your machine
  • The CLI is experimental and may have bugs that could affect your local files

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
